It must be placed at least 20 inches away from the swimming pool water’s edge. The fence must be a separate entity. It cannot be part of a privacy fence surrounding your yard, and it cannot attach to your home. Gates must be self-closing and open away from the water. They also must be self-latching and not be reachable by a small child. The lock must be placed on the side of the fence nearest the swimming pool.
Similar rules are in place for public swimming pools. Again, the fence must be at least 48-inches tall. The fence must have at least one gate within 10 feet of the swimming pool water and within 10 feet of any equipment storage shed. It must be located on the poolside of the gate, and it must be at least 54 inches from the ground and at least 3 inches from the top of the gate. The gate must open away from the pool. If a self-locking lock is used that requires a code to be entered or a key, then the device used to open the lock must be between 34 and 48 inches above grade. If the pool is in an enclosure, then the bottom 3 feet must be hardened.
